Purpose and acceptance
These terms govern access to and use of the Empa-T website and the services made available through it, in particular the contact and application forms.
By accessing the website, the user accepts these terms in full. Anyone who does not accept them should refrain from using it.
Permitted use
The website exists to present Empa-T and its services, to publish professional opportunities, and to receive enquiries and applications.
Users undertake to use it in good faith and in accordance with the law, and in particular may not:
- Carry out acts that compromise the security, availability or integrity of the website or of the systems connected to it;
- Access restricted areas, accounts or third-party data without authorisation;
- Use automated means to harvest content in bulk, save for indexing by search engines under normal conditions;
- Submit unlawful, defamatory or misleading content, or content that infringes third-party rights;
- Use published contact details for unsolicited commercial communications.
Intellectual property
The content of the website — text, images, photographs, video, trade marks, logos, graphics, structure, source code and other elements — belongs to Empa-T or to third parties who have licensed it, and is protected by copyright and industrial property law.
Consultation, printing and reproduction of extracts is permitted for personal, non-commercial use, provided the source is identified and ownership notices are not removed.
Any other use, including reproduction, adaptation, distribution, communication to the public or extraction of substantial parts, requires Empa-T’s prior written authorisation.
User-submitted content
Users who send messages, CVs or other content warrant that:
- The information is true, accurate and up to date;
- They hold the necessary rights over the content they submit;
- They do not include third-party personal data without a basis for doing so — in particular the contact details of professional references, which should only be provided where those people are aware of it.
Empa-T reserves the right not to act on communications that are manifestly unlawful, offensive or unrelated to the purposes of the website.
The processing of personal data contained in such content is governed by the Privacy Policy.
Professional opportunities and applications
Publication of an opportunity on the website constitutes an invitation to apply and does not constitute a contractual offer, nor does it bind Empa-T to engage any candidate.
Empa-T may amend, suspend or close any recruitment process at any time, without any resulting obligation to compensate.
The requirements, conditions and location stated in each advertisement are indicative and may be adjusted during the process.
Links to third-party websites
The website may contain links to third-party sites, including social networks. These links are provided for the user’s convenience.
Empa-T neither controls nor accepts responsibility for the content, policies or practices of those sites, whose own terms and policies should be consulted.
Availability and liability
Empa-T seeks to ensure the continuous operation of the website and the accuracy of the information published on it, without guaranteeing either. Access may be interrupted for maintenance, for technical reasons, or for causes beyond its control.
To the extent permitted by law, Empa-T is not liable for damage arising from:
- Temporary unavailability of the website;
- Errors, omissions or outdated information of an informational nature;
- Improper use of the website by the user;
- Transmission failures, viruses or other harmful elements originating from third parties.
Nothing in these terms excludes or limits liability that, under the law, cannot be excluded or limited, in particular in cases of wilful misconduct or gross negligence.
Data protection and cookies
The processing of personal data is described in the Privacy Policy. The use of cookies is described in the Cookie Policy. Both documents form an integral part of these terms.
Changes
Empa-T may amend these terms at any time, in particular as a result of legal changes or changes to the services offered. The applicable version is the one published at the time of access; the date of the most recent update appears at the beginning of the document.
Governing law and dispute resolution
These terms are governed by Portuguese law.
Any dispute arising from use of the website shall be submitted to the courts of the district in which Empa-T has its registered office, to the express exclusion of any other, save where a mandatory rule provides otherwise.
Under Portuguese Law no. 144/2015 of 8 September, in the case of a consumer dispute the consumer may refer the matter to an alternative dispute resolution body. The current list of available bodies can be consulted on the Portuguese Consumer Portal at www.consumidor.gov.pt.
